Terms of service

1. Acceptance
By creating a Fairly account, installing the Fairly browser extension, or otherwise using Fairly's products, you agree to these terms of service. If you do not agree, do not use Fairly.
2. Account eligibility
- You must be at least 18 years old.
- You must reside in the United States (Phase 1 launch geography).
- One account per person. We use email + behavioral signals to detect duplicates.
- You must provide accurate account information and keep it current.
3. Acceptable use
You agree not to:
- Misrepresent your profile attributes to inflate earnings.
- Use bots, scripts, or other automation to interact with Fairly.
- Attempt to access another user's account or data.
- Submit fraudulent coupon codes or wallet activity.
- Interfere with the operation of the Fairly extension or attempt to reverse-engineer its security mechanisms.
We may suspend or terminate accounts that violate these rules. Where fraud is involved, we may also reverse wallet credits or withhold cash-outs.
4. Wallet and cash-out
- Minimum withdrawal: $10.00. Below the minimum, your balance continues to accumulate.
- No withdrawal fees. Fairly absorbs processing costs.
- Processing time. PayPal cash-outs typically arrive within a few hours. Withdrawals over $500 may be flagged for manual review before processing.
- Pending vs. available. Affiliate commissions sit in a pending state for up to 60 days while the underlying transaction clears the network reversal window; they are not cash-out-eligible until they become available.
- Account-age requirement. The first cash-out is available 30 days after signup. This reduces fraud, not your earnings — credits accrue from day one.
- Failed payouts are reversed. If a cash-out fails (e.g. invalid PayPal address), the debit is automatically reversed and your balance is restored.
5. Browser extension
- The Fairly extension is provided as-is, free of charge, under a separate end-user license linked from the Chrome Web Store listing.
- The extension never auto-fills retailer checkout fields. Coupon codes are copied to your clipboard so you remain in control of every purchase.
- The extension may be updated automatically by Chrome to deliver bug fixes and improved retailer coverage.
6. Charity commitment
Fairly commits to allocate 15% of its annual profit — net revenue less operating expenses, floored at $0 in a year with no profit — to user-selected charities. The pool is calculated after the fiscal year closes and split across charities in proportion to the qualifying activity each user contributed and the charity each of them had selected across the relevant periods of the year. Disbursement is annual. Fairly publishes the revenue, operating expenses, resulting pool, and per-charity disbursements in an annual report. Fairly does not maintain a per-transaction charity ledger and does not represent a per-user charity total during the year.
7. Intellectual property
Fairly, the Fairly wordmark, the icon mark, and all related materials are owned by Fairly. You may not use Fairly trademarks without our written permission, except for approved press use governed by the press kit at /press.
8. Limitation of liability
Fairly is provided on an "as is" basis. To the maximum extent permitted by law, Fairly is not liable for indirect, incidental, or consequential damages arising out of your use of the service. Our total liability for any claim arising under these terms is limited to the amount you have earned through Fairly in the preceding twelve months, or $100, whichever is greater.
9. Dispute resolution
Any dispute arising under these terms will first be addressed via good-faith negotiation. If that fails, disputes will be resolved through binding individual arbitration in Utah, except where prohibited by law. You retain the right to bring small-claims actions in your local jurisdiction.
10. Changes to these terms
We will email account holders before any material change. Continued use of Fairly after a change constitutes acceptance of the updated terms.
11. Termination
You can terminate your account at any time from Settings → Delete account. We may suspend or terminate accounts that violate these terms, with a refund of any cash-out-eligible balance subject to fraud review.
